ARTICLE 2 — SUBJECT
This text sets out the parties’ rights and obligations regarding sale, delivery and return of goods/services ordered electronically from the SELLER’s website www.yagmurcicekcillik.com, under Consumer Protection Law No. 6502 and the Distance Contracts Regulation. The BUYER confirms having read and electronically approved preliminary information on product features, price, payment, delivery and withdrawal. Pre-information and the invoice form an integral part of this text.
ARTICLE 3 — CONTRACT DATE
The contract is deemed formed on the date the BUYER confirms the order and pays the price.
ARTICLE 4 — PLACE AND METHOD OF DELIVERY
Goods/services are delivered to the address and/or person specified by the BUYER. Date and time slot are selected at checkout.
ARTICLE 5 — DELIVERY COSTS AND TIME
Unless stated otherwise, delivery costs are borne by the BUYER. If free delivery is advertised, the cost is borne by the SELLER.
Delivery is made after stock availability and payment clear the SELLER’s account, within the period shown in the order/pre-information. The legal maximum is 30 days and may be extended by 10 days with written notice. If payment is not made or is cancelled, the delivery obligation ends.
ARTICLE 6 — BUYER’S DECLARATIONS
The BUYER inspects the product on delivery and does not accept visibly damaged, crushed, broken or poorly packaged goods from the courier. Accepted goods are deemed undamaged. Where withdrawal is available, the product must not be used and the invoice must be returned.
If, through no fault of the BUYER, the bank does not pay due to unauthorised card use, the product must be returned within 3 days if already delivered; return shipping is then paid by the BUYER.
ARTICLE 7 — SELLER’S DECLARATIONS
The SELLER delivers the product sound, complete and in line with the order. If delivery is to a third party who refuses it, the SELLER is not liable. Reasonable delay may occur due to weather or similar obstacles.
If performance becomes impossible for a justified reason, the BUYER is informed and the paid amount is refunded within 10 days. An equivalent product may be offered where appropriate.
ARTICLE 8 — INFORMATION AND DATA SECURITY
Identity and contact data requested in forms are used for orders, payment, delivery, notices, membership management and legal duties. Payment data may be shared with banks/payment providers to complete the transaction. Marketing electronic messages are not sent without commercial electronic message consent; unsubscribe options are provided.
ARTICLE 9 — PRODUCT FEATURES
Type, quantity, features and price (including taxes) are as shown on the product page, order summary and invoice. Fresh flowers may vary slightly in shade or form by nature.
ARTICLE 10 — CASH PRICE
The cash sale price is the amount shown on the order summary and invoice.
ARTICLE 11 — INSTALMENT / DEFERRED PRICE
If instalments apply, the amount follows the selected payment plan and bank rules as shown at checkout and on the invoice.
ARTICLE 12 — INTEREST
Where default interest applies, rates follow applicable law and the relevant bank agreement; the BUYER remains liable to their bank.
ARTICLE 13 — DOWN PAYMENT
Any down payment is as shown on the order and invoice.
ARTICLE 14 — PAYMENT PLAN
For credit-card instalments, the plan selected on the site and the cardholder’s bank agreement apply.
ARTICLE 15 — RIGHT OF WITHDRAWAL
Where statute allows, the BUYER may exercise withdrawal. For flowers and personalised goods, withdrawal is generally not available (see Article 16).
Where withdrawal is available, notice must be given by e-mail or phone; the product must be unused and the invoice returned. Refunds are made within statutory periods; return shipping may be paid by the SELLER where appropriate.
ARTICLE 16 — GOODS EXCLUDED FROM WITHDRAWAL
Goods not suitable for return by nature, perishable goods, hygiene/single-use products and goods customised to the consumer’s request are excluded. Fresh flowers and custom arrangements fall in this category.
ARTICLE 17 — DEFAULT
If the BUYER defaults on card or payment commitments, the bank/institution agreement and legal remedies apply. Damages from delay are reserved.
ARTICLE 18 — COMPETENT AUTHORITY
Disputes are resolved by Consumer Arbitration Committees up to announced thresholds, Consumer Courts above those thresholds, or Civil Courts of First Instance where no consumer court exists.
